The Act was actually signed into law on July 8, 2003, precisely. The Act has to pass through both the House of Representative and the Senate before it was signed into law by the President.

According to the Act, the Nigerian Communications Commission was given full capacity and was empowered to carry out certain functions in order to attain its goals, and these functions were regulatory functions.

Nonetheless, in this article, I am going to explain these regulatory functions, as was assigned to the Nigerian Communications Commission.

Having said that, it will interest us to know that, the power, which the Nigerian Communications Commission has, is gotten from the Nigerian Communications Commission Acts of 2003, _section 3.

What Are The Functions Of The Nigerian Communications Commission?

The Nigerian Communications Commission was established and assigned some functions. The reason why the Commission was assigned these functions was to aid the Nigerian Communications Commission in attaining its aims and objectives.

Although there are many of these functions, but in this article, I will be discussing a number of them. Below are the functions of the Nigerian Communications Commission:

1. Nigerian Communications Commission Gives Written Directions To Licensees

Nigerian Communications Commission is a regulatory body, which also has regulatory functions to perform. In most cases, the Commission as a regulatory body will license organization that intend to venture into communication business or that is already in the business.

In situations such as this, the Nigerian Communications Commission will have to give written directions to licensees. This aspect of the function of the Nigerian Communications Commission is quite necessary and important.

2. Consults With Industrial Organizations, Commercial Organizations And Consumers Organizations

This is another major function of the Nigerian Communications Commission, and it is very important since it is a Communications regulatory body.

These organizations, such as the consumer’s organization and industrial organization and commercial organization need information and Communications to thrive or drive their businesses.

That is why, for the most part, the Nigerian Communications Commission has to consult with these organization perhaps, for the purpose of communicating their businesses to the members of the public.

3. Delegates Functions To Committee It Has Constituted

Nigerian Communications Commission, as a regulatory body cannot or may not handle all its statutory functions, and therefore, it has to delegates these functions in order to ensure smooth and efficient running of the Nigerian Communications Commission.

To delegates these functions, the Nigerian Communications Commission must first constitute a committee. It is this committee (s) that the Nigerian Communications Commission will delegates functions of the Commission to, and on delegating of these functions to committee (s), the committee is therefore, expected to carry out such regulatory functions as delegated to it by the Nigerian Communications Commission.

Therefore, one of the functions of the Nigerian Communications Commission is to delegate functions to any committee that it has constituted.

4. Summons Persons Before The Nigerian Communications Commission

There are some occasions, where there are some issues that needed the Nigerian Communications Commission to intervene.

It could be a sort of grievance between two individuals or two organizations. Therefore, for the Nigerian Communications Commission to be able to address such issues, the Commission has to summon the parties involved.

That is why, one of the functions of the Nigerian Communications Commission is to make sure that it summons persons for them to appear before the Nigerian Communications Commission, should there be such occurrence of conflicting interests.

5. Enters Into Contracts With Persons, Firms And Organizations

Entering into contracts with persons and companies and organizations is part of the functions of the Nigerian Communications Commission.

Although the Nigerian Communications Commission is a regulatory body, but it however needed funds to administer the Commission hence, the Nigerian Communications Commission has been empowered to make sure that, it enters into contracts with persons and companies and organizations, and that means business.

So to enter into contracts with persons and companies and organizations is another function of the Nigerian Communications Commission.

6. Nigerian Communications Commission Establishes And Maintains Subsidiaries

The Nigerian Communications Commission needs subsidiaries to help it drives its mandate, and therefore, it is the function of the Nigerian Communications Commission to make sure that it establishes subsidiaries or what I may called, auxiliary aid to aid the Commission achieve its aims and objectives.

Besides the establishment of such subsidiaries, it also the function of the Nigerian Communications Commission to ensure that, these subsidiaries are maintained in order to make them discharge their responsibilities creditably.

7. Issues Licenses And Imposes Terms And Conditions On Licenses

Another function of the Nigerian Communications Commission is the issuance of licenses. As a regulatory body, the Nigerian Communications Commission is empowered to make sure that it issues licenses to organizations.

Besides the issuance of licenses to organizations, the Nigerian Communications Commission is also in charge of ensuring that there are imposition of terms and imposition of conditions on every license issued.

In other words, the Nigerian Communications Commission is not only responsible for issuing licenses, the Commission is also responsible to impose conditions and terms on licenses.

8. Consults With Affected Licensees Before It Brings Into Force An Obligation

This is yet another function of the Nigerian Communications Commission. I mean the consultation with the licensees that are affected before it makes any attempt to bring into force whatever obligations that may seem to be onerous on the part of the licensees.

This is very vital and necessary, because if the Nigerian Communications Commission does not consult the affected licensees before the Nigerian Communications Commission bring into force such obligations, which of course, may likely be onerous on the licenses, it may however spelled doom to the licensees.
