4 Functions Of Nigerian Law

Law, the world over, served a great deal of purpose in both the ancient and modern society. Therefore no single society can survive without law, rule and regulation.
Any society that hoped to survive and coexist must ensure that some principal functions are observed or established in the society.
To say the least, these principal purposes are very essential in allowing the society to thrive maximally, and here are these principal functions, they are about four in number, that is the establishment of standard and order maintenance and dispute resolution, as we as, protection of human liberties and rights in the society.

All these principal purposes are the function of law in the society, and without these principal functions in the society, such society is bound to disintegrate as a result of chaos. Having said that, in this article, I am going to explain a good number of functions of law in the society.
But do not forget that, for society to thrive maximally and successfully human liberties and their rights must be protected.
Order must have to be maintained also, as well as, provision made for the purpose of dispute resolution. And finally, standard must be established in the society as well.

Functions Of Law In The Society:

Law is an indispensable element in the society. It is so important to have law in the society with a view to help regulate human activities in the society.
Since nobody is above the law, it is expected that, all should have respect to the law of the land and as well, keep to the law, as expected from every member of the society.
Going by this, I am obliged to explain some of these functions of law in the society in this article, and here they are:

1. Law Establishes Standards In The Society

Standard is one of the principal functions of law in the society, that is why, no society can do without law. And law is all about setting standard in the society for everyone to follow, so establishment of standard in the society remained a principal function of law in the society.
And you should never forget that, law is a guidepost in the society. For that, I mean, law, as a guidepost, described and defined behaviour acceptable in the society. Law prescribed human activities and behaviours within the society.
Of course, you know that, in a society, there are some behaviuors that are enmity to the progress of the society and the function of the law to this regard is to forbid such behaviours in the society.
And there are some behaviours in the society that can actually engender the growth and development of a society, and law promotes these behaviours in the society.
Take for example, to commit crime in the society is against the law of the land, and the law forbid crime in the society.
The reason is obvious because through a legislative arm of government, a bill might have been passed, and in most cases, it is determined that the society will not tolerate  any behaviour that is enmity to itself or damage persons or injured persons, as well as, their properties.
Typical example is in the case of state law, it is considered a crime, when  physical injury is caused to another members of the society without justification. And where this happened, it is called, ‘crime of assault’.

2. Law Maintains Order In The Society

Law maintained order in the society. This is true of a society where there is peace and order. That is why maintenance of order is one of the principal functions of law in the society.
Maintenance of order in the society is the shoot off of the establishment of standards in the society. When standard is established in the society, there is bound to be order. And when there is order, the society will progress.
Many resemblance of order that is maintained in the society is very important and necessary in the society for such society to keep on thriving to greatness.
And this order enjoyed in the society is actually a reflection of the law. More so, it is note worthy to state the important of law enforcement here, because without the enforcement of the law, the law may not be observed.
That is why, law must be enforced by all means to not only ensure compliance, but to make sure that there is provision where order is consistent with the guidelines of the society.

3. Law Ensures Dispute Resolution In The Society

In every society, there is bound to be issues, disputes, and there is nowhere disputes can be avoided in a civil society.
Let us not forget that, society is made up of humans, and in essence, where there are human being, disputes can never be avoided.
The reason is obvious, people are of different background, with diverse opinions, and views and wants and values and needs.
Going by this fact, there is obviously the need to ensure disputes resolution in the society.
Therefore, it is the function of the law to make provision for the purpose of disputes resolution in the society.
The formal means by which, disputes can be resolved in the society is the court of law. The judicial system has provided courts in the federal level, state level, even in the local government level for the resolution of disputes.
Apart from the court of law, other different means for the resolution of disputes that are considered less formal also exist, and this less formal means, where disputes are resolved is known as the ‘Alternative Disputes Resolution.

4. Law Protects People’s Liberties And Rights In The Society

The constitution of Nigeria has made provision for various human liberties and human rights. One of the functions of the law is to ensure the protection of people’s liberties and human rights from being violated, and against intrusions that are not reasonable by individuals and groups and organizations, or even government.

Conclusion

Never forget that, for society to thrive maximally and successfully human liberties and their rights must be protected.
Order must have to be maintained also, as well as, provision made for the purpose of dispute resolution. And finally, standard must be established in the society as well.
