Senate tussle: Akpabio to appeal judgement

The Court of Appeal, Abuja Division, has given Senator Godswill Akpabio permission to appeal the court’s decision to remove him as the validly chosen candidate of the All Progressives Congress for Akwa Ibom North-West (Ikot Ekpene) Senatorial District and replace him with DIG Udom Ekpoudom (retd.).InformationGuideNigeria

In the Appeal filed by Ekpoudom against the APC and INEC on November 14, 2022, the Court of Appeal ruled that Ekpoudom would represent the APC in the 2023 elections for the Akwa Ibom North-West (Ikot Ekpene) Senatorial District.

Akpabio’s attorneys, Umeh Kalu SAN and Berth Igwilo SAN, had moved for leave for Akpabio to be joined in the Appeal, as he was not a party to the proceedings, so that he might seek mercy from the Supreme Court.

Delivering judgment on the Motion for Leave after hearing Mr Umeh Kalu, SAN, Berth Igwilo, SAN, the three-man Panel of the Justices of the Court of Appeal, led by Hon. Justice U.A. Ogakwu, unanimously granted Akpabio’s prayers, stating that it was satisfied that the applicant had deposed to sufficient issues in his affidavit and additional affidavits to warrant the grant of Leave to appeal the case.

Since Senator Godswill Akpabio’s name had previously been given to INEC as the APC candidate, the court ruled that he must be permitted to challenge the court’s decision rendered in his absence.JAMB Portal

Commenting on the decision, Umeh Kalu, SAN, praised the Justices’ good reasoning in the decision, stating, “You cannot shave a person’s head in his absence.

According to this judgement, Akpabio is anticipated to petition the Supreme Court by the end of the week.
