IGP explains why Tinubu is yet to prosecuted for alleged certificate forgery

Usman Alkali Baba, the Inspector General of Police, has informed a Federal High Court in Abuja that presidential candidate of the All Progressives Congress, Ahmed Bola Tinubu, has no pending petitions or criminal charges with the police anywhere in the country.

However, the IGP, through his attorney Wisdom Madaki, stated that the police lack the authority to charge Tinubu in the absence of a known offence.

He stated that the two petitions against Tinubu were based on claims that had been adjudicated by the Supreme Court in 2002 in a case brought by the late Chief Gani Fawehinmi, the preeminent human rights campaigner.

Alkali emphasised that the case had been resolved by the Supreme Court and that the police did not need to reopen the investigation.

The IGP, who asked the Federal High Court to dismiss the suit brought against him and the Nigeria Police Force for lack of merit and jurisdiction, also stated that the police do not need a court order to make an arrest or bring a prosecution because they derive their authority from the Constitution and laws.

Justice Inyang Ekwo approved Mr. Eme Ekpu’s request for further time to review the counter-affidavit filed by the police and to provide a formal response on Tuesday, November 1st, when rendering a ruling in the case.

Then, Ekwo scheduled the matter hearing for January 19, 2023.
