Appeal Court declares Imo PDP primaries’ venue valid, affirms Rep Chinedu’s election

The Imo State Election Petitions Appeal Court 2 in Lagos has confirmed Emeka Martins Chinedu of the Peoples Democratic Party (PDP) as the rightful candidate and elected representative for the Ahiazu/Mbaise/Ezinihitte Federal Constituency.InformationGuideNigeria

This decision was unanimous among the Appeal Court Justices, who, under the guidance of Justice Biobele Georgewill, upheld the trial court’s findings. They dismissed appeals from Nnanna Igbokwe of the All Progressives Congress (APC) and the Labour Party’s Darlington Amaechi, stating that the appeals lacked merit.

This verdict has settled the ongoing debate over the PDP primaries’ location, previously viewed as an issue beyond the Appeal Court’s reach. Earlier, both APC and the Labour Party had questioned Chinedu Emeka’s election over these concerns.JAMB Result

The decision mirrors the judgment from the Tribunal for National and State Assembly Elections for Imo State on September 7, 2023. The Tribunal declared Emeka Chinedu the true winner and stated that other parties couldn’t interfere in another party’s internal matters. The Tribunal also indicated that the venue issues concerning the primaries were pre-election matters, not within its jurisdiction.

The Supreme Court previously validated Emeka’s primary election. All these court levels—High Court, Appeal Court, and Supreme Court—have consistently backed Emeka Chinedu as the genuine PDP candidate. Chinedu Emeka’s fellow representative, Ikeagwuonu Onyinye Ugochinyere (Ikenga) of the Ideato North and South Federal Constituency, had his PDP primary elections at the same place. All courts affirmed Ugochinyere’s right to contest the election, making challenges based on the primary’s location pointless.JAMB Portal

The Centre for Judicial Integrity Watch praised the Appeal Court’s ruling as a democratic victory. Abubakar Isah, the group’s Convener, expressed surprise over the Appeal Court’s inconsistency in rulings, especially involving Jonas Okeke, whose primary was held at the same location as Chinedu Emeka’s. He urged the Court to maintain clarity and consistency in its decisions.
