In a unanimous judgment, the appellate court resolved all three issues raised for determination against Uba and the PDP. The court held that Uba failed to establish the forgery of INEC Form EC9 by Deputy Governor Samuel Ode beyond a reasonable doubt, as required by law.JAMB Result

Additionally, the court stated that the issue of non-qualification is a pre-election matter that should be challenged at a Federal High Court, not at the Governorship Election Petition Tribunal, as Uba had done. It also noted that a suit to challenge non-qualification must be instituted within 14 days of the occurrence of the subject matter.NYSC PORTAL

Furthermore, the court addressed the allegation that Governor Hyacinth Alia’s name was not submitted to INEC by the APC within 180 days before the election. The court held that this allegation could not stand as the primary election that produced Alia was ordered by a high court and was conducted within the timeframe ordered by the court.JAMB Portal

In conclusion, the Court of Appeal found that Uba’s appeal against the judgment of the Benue State Election Petition Tribunal lacked merit and upheld the tribunal’s judgment, affirming Hyacinth Alia’s election as the governor of Benue State.
