Reps seat: Court nullifies substitution of PDP candidate

The Independent National Electoral Commission was mandated by a Federal High Court in Abuja on Monday to recognise and publish the name of one Sani Yakubu Noma as the Peoples Democratic Party candidate for the Argungu/Augie Federal Constituency of Kebbi State in the general elections of 2023.Information Guide Nigeria

The PDP leadership’s substitution of the plaintiff’s name was ruled invalid by the court as being illegal, illegitimate, and unconstitutional.

In a lawsuit filed against the PDP and others, Noma claimed that he ran in the PDP’s primary election for the Argungu/Augie federal constituency on May 25, 2022, and won after receiving the most votes.

He said that the PDP submitted his name together with one Garuba Argungu, who was the sole candidate running at the time.

Noma, through his attorney John Usman (SAN), filed a lawsuit against PDP, Garuba, INEC, and other parties after learning that his name had been changed illegally on the INEC list.

In his ruling on Monday, Justice Baba Gana Ashigar stated that the PDP had violated the law when the plaintiff’s name was substituted.

The substitution was declared invalid by Justice Ashigar for being against the law, illegitimate, and unconstitutional before it was set aside.

The judgement then commanded INEC to declare the plaintiff the legitimate PDP candidate for the federal constituency in the House of Representatives election slated for February 2023, and to accept and publish his name right away.

For the House of Representatives election, Justice Ashigar forbade PDP and INEC from recognising, accepting, or listing any other name save that of the petitioner.

After being issued with the original summons, the PDP and Garba Argungu filed preliminary objections to the lawsuit, disputing the court’s authority to hear the matter.

However, Justice Ashigar disregarded the preliminary objections raised against the plaintiff’s lawsuit and concurred with Usman that they were unjustified, baseless, and frivolous.
The court upheld all of the points made by the plaintiff through his attorney, Usman, that the plaintiff’s case was meritorious and should be awarded the reliefs requested when it came to the first summons.

The judge subsequently issued an order to INEC directing them to accept and publicise the plaintiff’s name as the PDP candidate for the Argungu/Augie federal seat of Kebbi State in the general election of 2023.JAMB Result
