Justice Nathaniel Ayo-Emmanuel held that the March 8 primary election conducted at the WOCDIF Centre in Osogbo, which produced Dotun Babayemi, was null and void.
Justice Ayo-Emmanuel, who cited Section 84 (14) of the Electoral Act dismissed the suit filed by Babayemi. He said it was only the aspirant(s) who participated physically in the primary conducted by the PDP National Working Committee, and not the one conducted by the state executives, have the power and locus standi to challenge such suit in court. He thus upheld the primary conducted by the PDP National Working Executive Committee at the Osogbo Township Stadium which produced Adeleke. jamb results
