Court extends Seun Kuti’s days in police custody

A Lagos Chief Magistrate’s Court sitting at Sabo-Yaba, yesterday, ordered that afrobeat singer, Seun Kuti, should spend four more days in police custody, over alleged assault on a police officer on the Third Mainland Bridge, Lagos. THE GUARDIAN reports.Information Guide Nigeria

Chief Magistrate Adeola Olatubosun made the order sequel to a motion ex-parte brought by the police, seeking for an extension of Seun’s remand order in police custody for four days, at the State Criminal Investigation Department (SCID), Yaba, Lagos, to enable them carry out further investigation.
Simon Lough (SAN), Yetunde Cardoso, P.A. Egbunike, Umar Bello, Cyril Ajifor, Mr. Moruf Animashaun, Ayodele Oladiran, S.A Adebesin, Emmanuel Eze, V.I Ekperezie and Idowu Osungbure led the team of prosecution counsel.

They told court that they filed the motion supported by 12 paragraphs affidavit with one exhibit attached to it.

Lough, who told the court that the motion was supported with a written address, added that the 12 paragraphs affidavit was deposed to by one Saheed Kassim, an Investigating Police Officer (IPO) attached to State Criminal Investigation Department, Yaba Lagos.JAMB Portal

The application was brought pursuant to Sections 264(1) (2),(3),(4) & (6) & 257 of Administration of Criminal Justice Law of Lagos State, 2021 (As Amended), Sections 4 & 10 of the Police Act, 2020 and Sections 6(6), 35(1)(C), (5) & (7)(9) of the Constitution of the Federal Republic of Nigeria, 1999 (As Amended).

He said: “It is our humble submission that from the facts, nature and circumstance of this case, the applicant is entitled to the relief sought from this honourable court in the interest of justice, public order and morality.”

Responding to prosecution’s submission, Femi Akinyemi counsel, who held the brief for Adeyinka Olumide-Fusika (SAN), the defendant’s counsel, prayed the court to stand down the matter.

But Chief Magistrate Olatubosun refused the prayer of the defendant’s counsel for a stand down and subsequently granted the prosecution’s prayer for extension of remand order.

She ordered that the defendant be further remanded in police custody for four days, while the file be duplicated and sent to the Director of Public Prosecution (DPP) and subsequently adjourned to May 23, 2023.

Kuti, who adorned a wine-coloured shirt on blue jean, was accompanied to the court by mobile police officers at about 12:58 p.m.NYSC Portal

He was, however, taken away at 1:11p.m. in police White Hilux Van with plate numbered covered.

He sat at the back seat and in the midst of police officers.
