Kogi drags Dangote to court over Obajana ownership

The government of Kogi State has filed a lawsuit against Dangote Industries Limited, the parent firm of Dangote Cement Plc, regarding the ownership of its cement plant in Obajana, a town in the Oworo division of the Lokoja Local Government Area.Information Guide Nigeria

The complaint was filed with the Kogi State High Court, Lokoja Judicial Division, according to a copy of the originating summons marked HcL/8T/2022 that was made available to our correspondent.

In a lawsuit filed on October 18, 2022, the state government is requesting that the court analyse the agreement between DIL and the government of Kogi on July 30, 2002 and February 14, 2003, in order to determine why the contract lacked proper consideration.

In the event that the above claim is validated, the government also asks the court to invalidate the agreement for lack of proper consideration, which is an essential element of a legitimate contract.

The summons partly read, “Whether upon careful examination and consideration of the agreements made between Kogi State Government and Dangote Industries Limited on the 30th day of July, 2022 and 14th day of February 2003 respectively, it is not apparent that consideration (an essential ingredient of a valid contract) is lacking”?

The state government is also seeking a determination that Dangote Industries Limited has no profit, interest, or rights from the incompetent contracts entered into on July 30, 2002, and February 14, 2003, respectively, because it failed to provide the Kogi State Government with consideration.

In addition, it seeks an order nullifying the contracts signed on July 30, 2002 and February 14, 2003, respectively, for lack of consideration.

Among the state government’s other requests is an order of perpetual injunction prohibiting Dangote Industries Limited, any of its agents or assigns, from further utilising and/or reaping the benefits of the agreement dated July 30, 2002 and February 14, 2003 between the Kogi State Government and Dangote Industries Limited.

The Secretary of the Kogi State Government, Mrs. Folashade Arike Ayoade, stated in an affidavit in support of the originating summons that the Kogi State Government registered Obajana Cement Company in 1992.

Jibrin Abubakar, a representative of the Corporate Affairs Department of Dangote Cement Plc, did not answer to phone calls and a text message requesting comments on the situation as of the time this article was filed. The court hearing date has not yet been determined.Jamb Result
